Florida Alimony

In Florida, alimony is governed by Florida Statute 61.08.  Either party may qualify for alimony, but stay at home moms are likely particularly suited for some form of alimony.  Florida offers four forms of alimony, bridge the gap alimony, rehabilitative alimony, durational alimony, and permanent alimony.  Sometimes courts grant a combination of different kinds of alimony.

Alimony is not granted in every case.  Rather, the court must determine whether alimony is appropriate in each individual case, considering a variety of facts and circumstances.

Understanding Types of Alimony

Bridge the gap alimony is designed to help with the transition from being married to being single.  It is designed for the short term, not to exceed two years.

Rehabilitative alimony is designed to assist one party in becoming capable of self support. This can be done one of two ways.  Either rehabilitative alimony allows for the redevelopment of previous skills, or the acquiring of education, training, or work experience so as to develop employment skills.

Durational alimony provides a party with assistance for a set period of time.

Finally, permanent alimony can be awarded based on a series of factors that are evaluated with different standards, depending on the length of the marriage.

In divorces involving stay at home moms, your Miami divorce attorney works to get alimony in cases where it is appropriate.

Florida Child Support

Child support is governed by Florida Statute 61.30.  Courts rely on child support guidelines to calculate the appropriate amount of support.  The courts evaluate the income of the parents as well as the number of children when assessing the appropriate amount of child support.
